i personally think it was self defense... i believe the guy made a mistake by chasing after them, but did not do so with intent of murder... when the guy jumped on him that was an act of self defense...

the real question is did this guy have formal jiu-jitsu training... if he did.. then he should have known when to let go of the choke..

To be honest I think he is just fine, whether he had training or not. He took care of business, and removed a piece of trash from existence. A Twofer.

For several thousand years, stealing could mean that everyone around you would grab you, then beat you to death, maybe stab you, stone you. Maybe they would cut off a hand.

Throw you in stock holds, let people pelt your face, draw and quarter you, flogging, whipping, etc. No limit of True punishments that cause actual deterrence.

The kid thought he was tough sh!t, and in return got demolished in a fight. Probably was a real prick, douchbag as well.

At the point someone leaps on you, I firmly believe you have the right to snap their neck afterwards. Nothing should be escalated unless your willing to put your life on the table. It solves problems of things escalating that way.

The 40 something year old man should face no charges.

Subtract one Criminal from 7,000,000,000.

That is 7,000,000,000 - 1 = 6,999,999,999

I think the human race will do alright.
 
Interesting, this is just 30 minutes from me. Moral of the story, if caught trying to steal from someone, run like hell.
