Would you sue if nurse error sent you to ER?

Hey bro's,

I recently got tested for allergies and decided to go for allergy shots. Yesterday, I had my first shot administered by a nurse at my family doctors. I waited around the office for about 10 mins and there didn't seem to be a reaction so the nurse said I could go. About 10 mins later, my chest tightened up and I was having trouble breathing. I was also coughing and my eyes swelled up making it hard to see. I went to the ER and they put me on an IV and administered Benadryl.

I spoke to my allergist this morning and he said that this type of reaction is very rare. A couple of things could have happened.
Allergy shots are supposed to be subcutanious as opposed to IM. I think he shot to deep and in the wrong spot. Or he could have shot too much as there was 3 vials with different dosages and he could have picked the wrong one.

I'm pretty angry today about what happened, but I don't think I want to pursue it. I finally found a family doctor I like and he's the best doc I've ever had. He knows I've juiced before and that I got an HRT doc to prescribe HRT for me. I've also had him do blood tests to monitor me well I am on Hormone Replacement Therapy (HRT). I think finding another doc would be very difficult.

What would you do in this case?
 
Nope, it didn't cost me any money. Health care is free so no medical bills to worry about. I lost a day and a half at work but that won't be taken from my pay.

I'm just angry because it could have been worse and I'm almost positive that this was nurse error. If I had gone to the ER later, I could have died. I also don't want this to happen to anyone else.
 
You could get hold of the College of Physicians and Surgeons, they will send you paperwork to lodge an official complaint......but as far as monetary compensation, don't hold your breath.
 
It could have been worse but it wasn't. There really are no legal remedies for what could have happened. I see your damages as relatively minor and not worth the hassle of a lawsuit, assuming you could find a plaintiff's attorney hard up enough to take the case.

Sorry that happened, but hell, people make mistakes. Fortunately it didn't turn out too bad.
