Customs and Religious Artifacts

I'm watching Law & Order on TV. It's about Indians smuggling Heroin using Religious Artifacts. Now I know it's a TV show but what they were saying is that it's illegal for US Customs to open and search anything that has anything to do with Religion.

They were searching a suitcase and there was some Religious Artifacts in and the police were going to open them up with a screw driver and the US Customs agent said you know you can get sued if you open it up.

What do you guys think of that?

It actually has some validity. Law enforcement treads lightly with regard to religion. Could be more or less for a customs agent, but it's definitely out there.
